Is Online Poker Legal in North Dakota?According to North Dakota state laws, "'Gambling' means risking any money, credit, deposit, or other thing of value for gain, contingent, wholly or partially, upon lot, chance, the operation of gambling apparatus, or the happening or outcome of an event, including an election or sporting event, over which the person taking the risk has no control. " Although charitable poker is allowed in North Dakota, my conclusion is that playing online poker could be illegal in North Dakota (especially since no casino gambling is allowed either). Will North Dakota Legalize Online Poker?In 2005, North Dakota came close to regulating online poker within the state's boundaries. After all the chatter, though, the bill failed to go through. Many states have reconsidered their stances towards online poker (and online gambling in general) after the Department of Justice declared that the Wire Act of 1961 only applies to sports betting (this happened in December 2011). Businessweek.com asked state lawmaker Jim Kasper - the man who pushed for the legalization of online poker in North Dakota back in 2005 - whether he's going to try to legalize internet poker again, and Kasper wasn't sure, although he seemed to think that the DOJ's previous stance on the Wire Act of 1961 affected his efforts in 2005. Can You Play Internet Poker in North Dakota?All US internet poker sites accept players from North Dakota even though the laws seem so say that playing online poker wouldn't be legal.
